Man accused in I-75 slaying wants charges dismissed in Ohio

New attorneys for an Illinois man facing the death penalty if convicted of a 2014 shooting on Interstate 75 want the specifications elevating the crimes to death dismissed.

Terry Froman's trial was continued for a third time in August after a Warren County judge granted Froman's request for new lawyers.

The 42-year-old man is accused of kidnapping and killing his ex-girlfriend, Kimberly Thomas on Sept 12, 2014, on I-75 in Warren County. He is charged in Kentucky with the murder of Thomas’ son, Eli Mohney, 17, in the kidnapping of Thomas.

Hamilton County attorney Perry Anaona and Warren County attorney John Kaspar were appointed as Froman’s legal team and have filed several motions on his behalf. A new trial date has not yet been set.

The defense attorneys argue in the recent motion that the specification that the crime resulted in the death of two or more people, which elevates the possible penalty to death, is not valid because one death occurred in Kentucky.

“Neither the act, the contact, nor the death itself occurred in Ohio (Mohney’s death). Therefore, specification one to counts one and two should be dismissed as this court is without subject matter jurisdiction to make the findings necessary to enhance the defendant’s sentence,” Anaona and Kaspar wrote in the motion.

Warren County Prosecutor David Fornshell said his office is penning a response, but said the law does not require the death of one or more people to be in the same state.

Froman is scheduled to be back in court in November for a pretrial hearing.
