Accused I-75 shooter’s case delayed again in Warren County

For the third time, a Warren County judge has delayed the capital murder trial of accused Interstate 75 shooter Terry Froman.

On Monday, Judge Joseph Kirby continued Froman’s trial, scheduled to begin on Aug. 15, after granting Froman’s request for a new lawyer.

Froman is accused of kidnapping and killing his ex-girlfriend, Kimberly Thomas, from Mayfield, Ky., on Sept 12, 2014, on I-75 in Warren County.

Froman, 42, is also accused of killing Thomas’ son, Eli Mohney, 17, in Ky., as he kidnapped her.

Last Wednesday, Kirby heard arguments on whether Froman was entitled to a new lawyer.

This is the third time the case has been continued. The first continuance was granted after Judge Robert Peeler recused himself because his nephew is the prosecutor responsible for handling the case against Froman in Kentucky.

Froman’s defense team requested the second continuance because of the illness of a psychologist expected to testify for Froman if there was a death penalty phase of the trial.

“I don’t blame Judge Kirby for his decision, as he’s just trying to make sure that we don’t have to re-try this case twice. Nor do I blame Froman’s now former counsel, as I’m sure they had a challenging client to deal with. Still, it’s extraordinarily frustrating to see justice delayed yet again. My thoughts today are with Kim and Eli’s family and friends, as they are ready to see a jury hold Froman to account for his actions,” Warren County Prosecutor David P. Fornshell said in a press release Monday.

Kirby indicated he will appoint a new lawyer for Froman in coming weeks and reschedule the trial.
