The clerk, Michael Pummell, said he told the man that the store did not issue cash refunds, but he could get store credit, according to the police report.

The customer became angry, and Pummell said he could smell alcohol on the man’s breath. The customer left the business but returned with another man and continued to argue.
“(Pummell) advised during the verbal disagreement, the customer was insisting on a refund and removed a black pistol from his pants pocket and brandished it in his direction,” according to the police report.
Pummell ran from the office toward the garage yelling for someone to call police.
When Pummell ran back into the office in an attempt to arm himself, he said the man pointed the gun again at him and customers then fired a shot, according to the report.
The men left in a late model Chevy Impala or Malibu. Another witness said he saw one of the men fire a shot in the air while leaving the parking lot. Others said they heard several shots fired.
Middletown police issued an alert for two suspects who were believed to be in route to Dayton. They were able to identify them through a credit card receipt.

The suspect vehicle was stopped Tuesday night on South Shore Drive by Dayton police.
Emmanuel Riang, 28, of Parkwood Drive in Dayton, was charged with two counts of felonious assault, carrying a concealed weapon, improper handling of a firearm in a motor vehicle and use of weapons while intoxicated. He is accused of having the gun.
Nader Adam, 20, of Monuth Street in Dayton, is charged with improper handling of a firearm in a motor vehicle and failure to report a crime.
Both Adam and Riang remain in the Middletown Jail. They are scheduled to be in municipal court on Oct. 9 for a preliminary hearing.
