Guilty plea entered in connection with October home invasion

A Middletown man has pleaded guilty in connection with the beating of an 82-year-old man during an October home invasion.

Russell Bumgardner, 28, was scheduled to go to trial on April 9 on the charges of robbery, assault and theft of an elderly person. On Friday, Bumgardner entered a guilty plea to aggravated burglary. Butler County Common Pleas Judge Patrica Oney set sentencing for May 18. Bumgardner faces up to 10 years in prison.

Robert Tester Jr., 40, and Kyle Peck, 20, both of Middletown, are charged with the same crimes. Tester’s trial is scheduled to begin May 19 and Peck is set to go to trial on May 26.

The men are accused of breaking through a glass window at Elmon Booth’s house in the 3200 block of Finley Street on Oct.6.

During a preliminary hearing in Middletown Municipal Court, Detective Steve Winters said the men indicated they planned to steal a four-wheeler in West Middletown, but when that fell through they returned to Middletown where Tester began kicking the back door of Booth’s house. He then picked up a brick and threw it, striking Booth, Winters said.

Peck and Bumgardner took Booth’s television, a can of change and his hearing aids, Winters said. The men sold the 24-inch television for heroin, he said.

The trio remained housed in the Butler County Jail in lieu of $120,000 bonds.
