The grand jury said that between Sept. 3 and Sept. 4 Gabbard’s actions of “committing or attempting to commit an offense of violence” and using a deadly weapon constituted the murder charge, according to the indictment.

David Mitchell, 41, was found dead Sept. 4 in an apartment on Eastgate Drive that he shared with Gabbard.

Officers were dispatched at 5:15 p.m. Sept. 4 for a well-being check requested by Gabbard’s friend, who told dispatchers the woman had called him crying and was “hysterical.”

Gabbard was arrested Sept. 5 for allegedly stabbing Mitchell to death.

Gabbard is being held in the Butler County Jail on a $1 million bond.
