Middletown man sentenced for child rape charges

Minutes before jury selection began Monday in his trial, a Middletown man plead out to child rape charges in Butler County Common Pleas Court.

Brian O’Leary, 40, of Grimes Street, entered no contest pleas to five counts of rape and one count of misdemeanor attempted disseminating matter harmful to juveniles. Judge Keith Spaeth then found O’Leary guilty of the charges and sentenced him to 20 years to life in prison. O’Leary was also classified as a Tier III sex offender, which means he will have to report his address to the sheriff every 90 days for the rest of his life if he is released from prison.

O’Leary was inducted by a grand jury in October for the crimes involving a 12-year-old girl. The acts occurred between September 2011 and June 2012 in Middletown, according to Assistant Butler County Prosecutor Jennifer McElfresh.

Court documents show O’Leary was charged with eight counts of pandering sexually oriented matter involving a minor in 2003. He plead guilty and was sentenced to two years in prison. He was classified as a sexually oriented offender at that time.
