Adam Summers, 25, of Acredale Drive, was driving a silver 2006 Infinity northbound on U.S. 42 when he struck a utility pole around 1:30 a.m. June 1, causing the vehicle to flip multiple times and split in two, according to West Chester Police.
Timothy Haunert, 42, of West Chester, was thrown from the car and killed.
Summer was indicted Wednesday on charges of operating a vehicle under the influence, operating a vehicle under the influence of marijuana and failure to control, according to court records.
Summers is scheduled to be arraigned Sept. 7 by Butler County Common Pleas Judge Craig Hedric. He is free on bond.
