Lebanon patrolman guilty in cruiser crash trial

A Lebanon patrolman was fined $25 and court costs today for failing to proceed with caution into an intersection where his police cruiser collided with a motor home on the Ohio 48 Bypass in Lebanon in June.

Judge William Wolff, a retired Montgomery County Common Pleas Court judge appointed to hear the case, sentenced Dan Fry, 37, after a trial Thursday in Lebanon Municipal Court.

Fry and his lawyer Charles H. Rittgers claimed the motor home driver should have yielded to Fry’s cruiser as he was headed to a reported fire.

But the case made by Lebanon police Capt. Dave Gehringer and Mark Webb, the appointed prosecutor, convinced Wolff that Fry was at fault.

“He should have come to a complete stop,” Gehringer testified, leaving the other driver too little time to stop the motor home.

There were no reported injuries, and the city’s insurance is expected to cover the damage to both vehicles.
