The officer stopped the black Mercury 4S with temporary registration and confirmed the registered owner to be wanted on a warrant.
The officer detected the odor of marijuana coming from the vehicle and asked the man to step out of vehicle. The officer placed the man’s hands behind his back but he attempted to move his hands away. The officer told him to stop and he was being handcuffed, but he continued to try to pull his hands away several more times and the officer called for backup.
As the handcuffs were being secured, the suspect said he had not been read his Miranda Rights but was told it was not necessary. The two officers got him into the prisoner compartment of the police vehicle and began to search his vehicle. They found a yellow marijuana bowl under the driver’s seat.
The suspect was charged with possession of marijuana drug paraphernalia and resisting arrest and was taken to the Butler County Jail. The car was impounded and the marijuana bowl placed into the property room.
