DNA evidence led police to a New York man who is charged with the sexual assault of a Middletown woman.

Luis A. Crus-Figueroa, 33, was arraigned Wednesday morning in Middletown Municipal Court for rape and aggravated burglary. His bond was set at $5 million by Judge Melynda Cook-Howard.

Crus-Figueroa is accused of breaking into a Spring Garden residence on Oct. 10, 2016, then sexually assaulting the female resident.

The victim said her attacker was wearing a white Halloween mask when she awoke to find him on her bed, according to police.

“The subject began speaking to her and told her he had been hired to kill her,” according to court documents filed by police. He said he had broken into the residence before and watched her sleep.

The woman said she became frozen with fear and was afraid he was going to kill her. A one point the man took off his mask and the woman saw her face.

The man forced entry into the residence through a rear window and fled when he heard a relative of the woman come down the stairs.

In November 2016, the woman reported she recognized the man who raped her by his face and voice and that he was stalking her at work, according to the police complaint.

Middletown police identified Crus-Figueroa as the suspect, but were unable to locate him.

In June, police were notified Crus-Figueroa’s DNA was a match in a case in Florida.

Middletown detectives travelled to Buffalo, N.Y., and transported Crus-Figueroa back to Middletown on Tuesday.
