He still faces trial on other charges stemming to allegations from 2013 and 2006 from different women, ABC News reported.
More than 75 women have accused Weinstein of sexual abuse. In June, he pleaded not guilty to six felony sex crimes, WCBS reported.
Weinstein's attorney argued that the grand jury didn't see all of the evidence in his defense. The evidence includes dozens of emails from one of the woman that attorney Benjamin Brafman says shows that the woman had a consensual relationship with Weinstein for years, WCBS reported.
