Tyler Joshua Richins of Alpharetta faces a felony charge after a witness caught him pretending to drop something on the floor as an excuse to take his phone out underneath a customer's skirt at the Milton restaurant, Milton police told Atlanta's WSB-TV.

"The employee was up near the front counter while the victim was waiting to get her order," Capt. Charles Barstow said. "He bent down to pick up what looked like some paper napkins, and then (the witness) observed him take his phone and slide it underneath the woman's skirt."

Upskirting, as it’s called, became illegal in Georgia in 2017.
The witness told the woman what happened and she confronted Richins, WSB-TV reported. The incident happened April 16 at the restaurant off Windward Parkway.
The franchise’s owner sent the news station a statement that said, in part:
“The safety of guests is our top priority, and we take this incident very seriously. Upon hearing of the situation, we immediately investigated. The individual at issue is no longer employed at my restaurant.”
He faces one count of using a device to film underneath or through an individual’s clothing, Fulton County jail records show. He bonded out April 24 for $10,000.
