Board members Tom York and Beth Benjamin were absent from the meeting.
The lawsuit, which was filed in the U.S. District Court of Cincinnati, alleges Daniel Benjamin’s behavior also includes harassing texts and sexually suggestive gestures.
The accusations were reported by former school custodian Leslie Sizemore to Edgewood Local School District officials, according to the lawsuit.
Daniel Benjamin is married to school board member Beth Benjamin.
Sizemore claims Edgewood officials did not take preventive action to protect her despite her complaints, forcing her resignation.
In the lawsuit, which names Daniel Benjamin, the four other Edgewood school board members and Edgewood Middle School Principal David Slamer, Sizemore claims school officials “took no action between September 2017 through July 2018 to investigate the allegations of sexual harassment.”
