NEW DETAILS: 28-year-old woman victim of deadly drug overdose in Warren County

The victim of the deadly drug overdose case that prompted an involuntary manslaughter charge revealed Monday in Warren County was Mallory Smith, 28, of Mason, according to Warren County authorities.

Warren County Prosecutor David Fornshell said Smith died on Oct. 24 after being taken from the Super 8 Hotel in Mason to Bethesda Arrow Springs in Lebanon by boyfriend Joseph T. Morrison.

On Monday, Morrison, 36, of Clearcreek Twp., was indicted on charges of involuntary manslaughter and corrupting another with drugs, as well as 10 counts of aggravated trafficking in drugs; tampering with evidence, trafficking in heroin and trafficking and possession of drugs.

Morrison was allegedly found in possession of drugs, including fentanyl and heroin, and sold drugs on multiple locations and provided the unidentified victim with “drugs which ultimately resulted in her death” on Oct. 23, 2017, or Oct 24, 2017, according to a summary included with a list of indictments released Monday.

On Tuesday, Fornshell said Smith’s overdose death occurred in the midst of a multi-agency investigation of Morrison involving Mason and Lebanon police, and the Warren County Drug Task Force.

The incident resulting in Smith’s death began when her boyfriend Morrison picked her up on Oct. 23 at her parents’ house, drove to Dayton and purchased “suspected heroin,” Fornshell said.

According to Fornshell, Smith and Morrison went back to the Super 8 motel in Mason, where they snorted the drugs from 4 p.m., Oct. 23, until 1 a.m., Oct. 24.

When Morrison woke up about 10 a.m., Smith was “very lethargic,” in and out of consciousness, so Morrison drove her to the emergency room at the medical facility off the Ohio 48 Bypass, Fornshell said.

The other charges stem from a separate, continuing investigation of Morrison as a suspected drug trafficker, Fornshell said.

If convicted on the on involuntary manslaughter slaughter charge, Fornshell said Morrison faces a maximum of 11 years in prison. He declined to estimate the potential sentence from the other charges.

Morrison is also alleged to have possessed and trafficked in fentanyl, a prescription painkiller mixed with heroin or cocaine, on Jan. 23, 2017, Jan. 25 and Feb. 15, 2018, according to the indictment filed in Warren County Common Pleas Court.

The indictment also alleges Morrison possessed Tramadol and used a 2003 Pontiac Grand Am in the criminal acts.

Morrison was in the Warren County Jail Tuesday, held without bond, pending his arraignment on Wednesday in Warren County Common Pleas Court, according to jail records.

He was arrested at 10:30 p.m., Monday, at his house on Ohio 122, according to jail records.
