Carlisle police chief put on leave for 'performance'

CARLISLE — The city’s police chief has been placed on indefinite administrative leave with pay.

City Manager Sherry Callahan confirmed Wednesday, Feb. 10 that Chief Tim Boggess was relieved as of Thursday, Feb. 4, “for basically the performance of his duties.”

Callahan said “there were numerous issues” that led to last week’s action, including issues involving Mayor Tim Humphries. She said attorneys for the city and Boggess are discussing the matter and that she is waiting for results from those discussions.

Boggess, 44, says he’s been told to resign by March 1 or be terminated and it’s because an officer did not show up in Franklin Municipal Court Jan. 25 for Humphries’ court date in an alleged “road rage” incident.

Because the officer didn’t show up for court, visiting Judge Mark Bogen dismissed the case against Humphries, which included a felony charge of obstructing official business and misdemeanor charges of aggravated menacing and prohibition against parking on highways as a result of the Dec. 1 incident.

Carlisle’s city charter says that department directors are appointed by the city manager and serves at the manager’s pleasure, and may be removed, without cause, by the manager.

“I’m in trouble because the officer didn’t show up for court,” Boggess said. “I’ve never heard of anybody being fired because an officer didn’t show up. I’m devastated right now.”

Boggess said he and his lawyer are looking at possible legal recourse in the matter.

The officer who didn’t appear in court is facing possible disciplinary action, Callahan said.

Callahan has appointed Greg Wallace, the city’s former fire chief, as acting safety director until she can name an interim police chief later this week. The department’s second in command, Lt. James Slyder, is on medical leave, she said.

Boggess has been Carlisle’s police chief since June 2004. He became a Carlisle police officer in 1997 and later was promoted to officer in charge in 2000, sergeant in 2001 and lieutenant in February 2004 before becoming chief. He served four years with South Lebanon police before joining Carlisle’s force.
