A former Middletown High School and current Miami University basketball player is facing a misdemeanor assault charge after a May fight in Middletown.

Devante Glenn, 20, of Gage Drive, said Allen Roberts assaulted him after cursing at him and enticing him to fight at a party on Breiel Boulevard on May 22, according to a Middletown police report. Also joining in on the assault was LeRoy Smith, according to Glenn.

Roberts, 21, of Oaks Circle, and Smith were gone when police arrived. Glenn suffered injures to his lip and eye. He told police the pair took his cell phone.

Glenn filed assault charges through Middletown Municipal Court against Roberts and Smith a couple weeks after the incident.

Roberts’ attorney, David Washington, said Glenn’s story is untrue.

“This is a private complaint, the police did not file charges … (the allegations) are completely false,” Washington said. “He (Glenn) is trying to use the legal system to damage the reputation of this young man because he is an athlete.”

Washington said a trial date has already been set for Sept. 21.

Smith, 18, of Forest Avenue, is scheduled to be back in court on Aug. 17 for a pretrial hearing. Both are free on their own recognizance.

It is not the first time Roberts has been arrested. In April 2011, Roberts and two friends were arrested by Oxford police and charged with assault. The charge was reduced to disorderly conduct and Roberts paid a fine.

He was also arrested on May 26 in Middletown for disorderly conduct when he did not stop for police who observed him an another man milling between cars in the Take A Break Lounge on Jackson Lane. Roberts pleaded guilty to a lesser charge and was fined $265.

First-year Miami coach John Cooper said Monday that he’s talked to Roberts briefly, but doesn’t want to make a rush to judgment regarding his status with the basketball program.

“I’ve been out of town recruiting,” Cooper said. “I’ve learned through the years not to rush and make sure you have everything you need. Once I have all the facts, then I’ll make a decision.”
