Suspect told police that accused ‘took turns’ with girl

Fairborn Police questioned four male suspects several times about an alleged April gang rape of a female minor before one of them told a detective that “they all took turns with the juvenile victim,” according to court documents obtained by this newspaper.

The suspect, who at the time of the incident was a juvenile, was confronted with DNA evidence linking his semen to the alleged victim at odds rarer than 1 in 1 trillion. He suggested to police that the link could have been traced to a handshake.

Two others — TJ Bailey, 18, and Chance Putnam, 21 — have been charged with rape in the case that police say involved an intoxicated female minor and took place in Bailey’s basement on West Xenia Drive.

The juvenile male whose June 30 police interview implicated Bailey and Putnam, has since turned 18 and was arrested in July and charged with rape and sexual battery. He said Bailey asked, “You gonna get in on this?”

Public court documents obtained from the Greene County Prosecutor’s Office illustrate an evening of heavy drinking and the alleged rape on Saturday, April 9.

This newspaper typically does not identify victims of sexual assault or juveniles in crimes unless they are charged as adults, which prosecutors said has not happened.

Putnam and Bailey were arrested Wednesday in connection to the incident, according to Fairborn Police.

A fourth suspect — also a juvenile male, prosecutors said — had not been arrested as of Friday afternoon.

‘Couldn’t even move’

The victim, whose age has not been released, told a consistent story to officers during multiple interviews in April, court records show. Before consuming alcohol, she said the males asked her to participate in a “five-way.” She said she refused.

She fell down several times after shots of hard liquor, and the males picked her up and carried her to a futon, she told police. Bailey, Putnam and one of the juveniles performed numerous sex acts with her, according to her statement, while the fourth juvenile was passed out.

At one point, during allegedly forced oral sex, she vomited. They stopped.

“It almost doesn’t feel real,” she told police. “I trusted them and I trusted they would not hurt me like that.”

“I (couldn’t) even move,” she texted Bailey.

‘Play this card’

Each of the male suspects originally told police they had no part in the alleged crime, although police would later confront them with DNA evidence and text messages, court records show.

The second juvenile, who the victim said was passed out before engaging in sex acts, met with detectives on April 13. He admitted to being at the party and taking two or three shots. But he did not see a lot because he fell asleep, according to court records.

He told detectives he woke up, saw Bailey and the victim, and heard her say “good job.” He told officers he does not know why she would “play this card.” He said there was no contact between him and the alleged victim.

One month later, in another meeting with police, his story changed. He told police he woke up and began kissing the victim as she gave him oral sex. He told police he stopped “because both of them were drunk and he was in a bad situation,” police wrote. “The juvenile victim told (him) the next day that she was upset it was not consensual but he told her it was.”

‘Shank them’

Putnam was arrested on April 26 for an outstanding, apparently unrelated warrant. He told police that he had 15 shots of alcohol in less than three hours on April 9, but was not “black out” drunk and remembers the night. He told officers he saw nothing between the juvenile victim and anyone else, and said nothing happened between him and her.

Bailey, on April 28, told officers the juvenile victim tried sitting on everyone’s lap and they had to push her off. He said that if what the alleged victim described did indeed happen he would “shank them in the kneecap.”

Bailey told officers he believed the victim would make up allegations because she thought he was going to tell her boyfriend that she was cheating on him. He refused a polygraph test, but agreed to submit DNA, court records show.

The charged juvenile, whose name this newspaper is not using, met with officers on May 5. He said had no contact with the victim, nor did he see anyone else. He agreed to give a DNA sample.

On June 30, his story changed after a Fairborn detective told him his semen was found inside the alleged victim. At first, he denied it and attempted to explain he and the victim shook hands.

The detective wrote “he was finally going to tell me the truth.”

“He explained that they were all downstairs drinking and taking shots when he got really sick,” the detective wrote. He “went upstairs to throw up and when he came back down he saw that TJ and Chance had the juvenile victim’s shirt off.”

Xenia attorney Cynthia Lennon, who prosecutors said represents the charged male treated as a juvenile, said she had no comment on the case.

Long process

Fairborn Police Sgt. Mark Stannard described the act as “heinous” and of a “sensitive nature.” He would not confirm whether the victim, who according to court records discovered a bruise on her body while at the hospital, received medical treatment.

He did indicate that police have spent months working the case.

“It’s a long investigational process,” he said. “We’re collecting evidence, comparing and analyzing evidence and evaluating evidence.

“We want to be thorough,” Stannard added. “We don’t want to miss any potential evidence.”
