HAMILTON — Butler County commissioners approved an agreement with Dynus Corp. July 28, 2005, allowing the company to use four of the county's fibers in exchange for the company luring new jobs and investment to the county.
Jim Smith, Dynus president, was estimating $6 million to $10 million in annual revenue for the county.

But Butler County Auditor Kay Rogers' involvement with Dynus and Smith began long before that. Her office took over the county's fiber optics project after the project manager's termination in early 2004.
A document dated Sept. 15, 2004, stated that Smith was an agent of the county in seeking a $5.3 million loan from National City Bank.
"The undersigned being duly elected and acting as auditor of Butler County, OH (the "Lessee") does hereby certify that the person or persons listed below are authorized representatives of the Lessee," it states, followed by Rogers' and Smith's signatures.
On Dec. 31, 2004, Rogers signed a resolution stating Butler County would borrow roughly $5.3 million from National City Bank. The resolutions listed Rogers and Smith as representatives of the county.
National City then loaned Dynus $4 million, on the understanding Rogers would provide an opinion from the Butler County attorney on whether the deal was legitimate.
County officials received a bill from National City in September 2005 requesting a $99,485.78 payment on a lease agreement in the county's name for fiber optic equipment. Officials said they never authorized Dynus to do any actual work.
Then county Commissioner Michael Fox, a driving force behind the fiber optics project, said that the commission had no idea that Rogers was negotiating with the company independent of the county. "There were apparently two conversations going on," he said.
Accusations quickly flew, with company executives accusing Rogers of giving them the go-ahead, while Rogers said some of the documents bearing her signature were forged. Other documents surfaced carrying Fox's signature, which Fox also said were forgeries.
Commissioners severed their agreement with the company in September 2005 and Commissioner Charles Furmon called the FBI and asked for an investigation.
"I didn't now who was guilty of what or what to expect. I just knew there had been violations and I wanted to handle it properly and make sure it's not swept under the rug," Furmon said.
The issue led Fifth Third Bank to cancel a line of credit with Dynus, which caused the company to close its doors and fire its roughly 60 employees.
National City released the county from any obligation on the loan, but Dynus sued the county in February 2006 for $12 million, the value of a disputed contract with the county plus undetermined punitive damages.
The company dropped its lawsuit in September 2006, saying they wanted to give the FBI investigation time to pan out. The deadline to refile came and went, and the investigation went on for a year and a half.
Smith did not return calls for comment Monday.
Should Rogers resign, she would be the second elected county official in the past year to step down after pleading guilty to a crime.
Treasurer Carole Mosketti resigned her post last spring after pleading guilty to a first-degree misdemeanor following state ethics charges.
Mosketti stepped down May 31, shortly after she entered the plea linked to the hiring of her granddaughter as a deputy treasurer.
Until Rogers' plea was released, she maintained her innocence.
"I did nothing wrong," she said in a statement last year. "I am concerned that some of the forms in question appear to contain fraudulance (sic) and do not contain my actual signature. This is also apparently true of one of our commissioners and one of the employees of my office.
"As far as the forms that do contain my signature, I was only verifying my knowledge of the documents and the funds available to the county, since my office was overseeing the Fiber Optics Project. I was always clear to representatives from Dynus that the commissioners, and only the commissioners, may act as contracting agents for Butler County. If my signature was used improperly by outside agents, it is extremely unfortunate ... The commissioners know that in 10 years I have operated a highly professional office with full integrity."

You must believe “the shoe” will drop on George Lang and Scott Owens, but what’s to prevent them from “influencing” her - a witness - in the interim? Could the investigation spread to big business persons/big names in West Chester and how they have such low property tax evluations on their commercial property investments ?? John Doe, you are utterly incapable of forming a rational judgment. I am sure you are opne of Ms. Rogers’ biggest supporters, as well as the current President’s. You do not base your judgments on anything like facts; you base them on what your handlers tell you to.
Anyone who remembers the Clinton era in Ohio, and compares it with this era, and talks about the “hell of a mess” we’d be in if the Goppers were gone is probably too addled to vote, whether or not you can read a book.

Many Dynus employees are replying to this story, which is good. As we know, Kay went along with what Jim Smith cooked up with George Lang and Scott Owens, and of course Orlando Carter. All the nonsense that went on around the office and dirty politics wasn’t even neccessary. They company had so much going for it. Why in the world would they screw it up? Because they were not experienced business men. And contrary to popular belief, they are not intelligent men. They are all ego maniacs BS.

Roger’s failure to resign says to hell with the public that she serves…it’s all about her and the money.
No excuse should be allowed to explain her criminal acts – including her kids, nor for her inability to do what’s right to restore the public’s trust in government now! She’s damaging it more. Hopefully, the court will weigh this heavily to hand-down a harsher sentence. She’s shown no remorse and that her only interest is in taking more from those she no longer has the right to serve.

When K K CPA plead guilty she became a felon. Felons can’t vote. Felons cant hold office. Her last day of pay should be the day she enter a guilty plea. That is the only reason she is holding out to steal more money from the County..like she hasn’t stole from the taxpayers of Butler County. This is a classic example of voting “blind”. Basing your vote on party affiliation alone. Rogers achieved the office initially on this basis and continued to be re- elected because of the “R” after her name. This short sited affliction is not owned by Republicans but by Democrats as well. It is unfortunate that such a large percentage of voters are so spoon fed and lazy that they do not investigate issues or candidates. Do not look to Rogers to blame, she could only vote once.

Only government would allow an “employee” to remain in a position that they’ve admitted using to commit serious crimes nearly two months before (http://www.usdoj.gov/usao/ohs/Press/Rogers.pdf). To make matters worse, Rogers has no limitations to her authority, no foreseeable termination, and continues to receive the pay and perks of office.

Basically, she has shown no professional ethics in office for the past 5 years if the IRS statements are correct and she has been filing false income tax statements. I do not feel comfortable with her in a leadership position within government or private firms with accounting practices without ethics. She should resign now. Let’s not forget who gave his Butler County parking pass to his son’s girlfriend!!! He was caught after she got over $700.00 in free parking at the city garage at the expense of the taxpayers. Which is theft in office by CHUCK FURMON. After he was caught, he paid for the parking. But if he had not been caught, it would still be going on now. What else has the theft done that we don’t know about?? He has fallen a long way from being a great POLICE OFFICER!!

First, I know that all of the Dillingham (sic Ruscigno) supporters are running scared. Kay and RAWnica’s husband are the two behind the attempt to get rid of Chuck Furmon because he DID contact the FBI and request an investigation into the Dynus affair!
As to George Lang and Scott Owens, my money is on that Scott “Window Peeper” Owens is up to his neck in this and his loyal friend George Lang trusted in Owens to be an honest man and Owens crapped all over him, as he does all people.

CHUCK FURMON was NOT the one responsible for getting the FBI involved, but he sure IS TAKING ALL THE CREDIT! FACT - The IRS automatically gets called in when there is a question of bank fraud, which was perpetrated on National City Bank when Kay submitted her forged documents Dynus promptly got their loan funded! Furmon may be able to make political hay out of this, but he is the lesser of two evils at this point in the game. This helps him beat RAWnica, but then, that’s not saying much!

With any plea deal comes the revelation of new information. With former Dynus employees George Lang and Scott Owens, you’ve got to wonder the extent of their Dynus involvement especially with Rogers acting as treasurer of Lang’s campaign and Owen’s using his foot to gain access to the inner sanctums of government buildings. Not to mention the foot dragging by Pipers office and a quick exit by Fox. If any of them are implicated I would expect the Butler GOP to ask for all of their heads.

what is really a shame, is that ms. kay gets away with millions of dollars, while those in the trenches, working for BCJ&FS can’t even get free parking in the garage!! they have to trudge many blocks to reach their cars, wasting valuable manhours and client hours. i hope ms. kay can take some of her $ and spend it in the rpison gift shop!! glad i do not live in butler count!!!

I’m an honest working homeowner in butler county and want our real estate taxes investigated because I’m wondering if we homeowners have been robbed in our property taxes. I also think they need to fire the whole county government and start over because the court system is a dictatorship that holds butler county families hostages and harms families. I tried to turn to Mike Fox for help and he completely ignored my requests to help my children in this legal system and my children suffered.

I think that we really need to look into all of our gov’t officials. you never know who is waisting our hard earned money. And I whole heartly agree with the fellow who pasted on the 25th Sammy. The only way our city is ever gping to head in the right direction is to get newpeople in there. As a lifelong conservative and Butler Co. resident I am embarrassed by this episode. Ms. Rogers should do the right thing as a covicted felon and resign immediately. I also have to agree with those on this forum who’ve expressed their frustrationwith the Good Old Boy network. Our pending choice for commissioner leaves me torn to choose the lesser of two evils rather than someone I can trust….one liar/cheat vs. another of the good old boy Mike Fox lemmings….argh.

If Rogers had any class, she’d resign now! Doubtful she will, even if she’s sent to jail. And, that’s exactly where she belongs given her role’s fiduciary responsibilities.
She lied, took money, and let this ruse go on far too long, likely putting the county at risk for future litigation and costly remedies. Her tenure’s an embarrassment (flooded basement, etc). Hopefully, pictures of her kids and cries for leniency will not sway the court from delivering the stiff penalty she deserves.

I remember about a dozen years ago when one of her employees passed away. This gentleman began working there when Ray Tilton was auditor. People from the office came to the funeral home, but told me that they were instructed (by Ms. Rogers herself) not to go in until she arrived and then they would all go in together, and by God, they waited! This should tell you something about this woman and her control freak attitude. I’m glad she got caught and deserves whatever she gets and should worse.

I didn’t vote for Rodgers. I think the FBI should check out the whole City of Hamilton officials. There are way too many perks being in the “City Club”…cars, gas, jobs for the family… certain female Judge needs to go too.

I can’t believe all the good sheep(Republicans) are so surprised at Ms. Roger’s illegal activity. These activities are the norm for Republicans. Nixon, Who by the way holds the second lowest rating of any president) had his little spy and money laundering ring. Reagan’s private arms dealers were selling arms to Iran and Iraq to finance coups in central America, so the heroin routes were open. And Bush, Who holds the prise for lowest rating of any president, I’m surprised she was caught here.

All those people that Kay did tax work for that earned her $56,000 should be checked out. Property evaluations for people like George Lang have been questionable for years. My thanks to Chuck Furman for having the guts to seek outside investigation (FBI) on the Auditor. He has taken a lot of heat for doing what endied up being the right thing to do. As for Dilingham…enough said.

The voters of Butler County got what they wanted. I didn’t vote for Ms. Rodgers in the last election because of these and other aligations. Wake up people! If you elect a felon to public office, you should not be shocked when they break the law. I voted for Zettler.

I think that its time for Kay to go, all I can ever remember about her is she was always doing questionable things. Doesn’t she have enough digity to leave? Now we hear things about Dillingham, from her own camp, how do these people have the nerve to place themselves up on a pedistool? Its not so much which party they are part of, its their own characters and their own greed. Granted the Republicn party seems to have their share of crooks.

Maybe they should check a former Hamiilton Council member that built houses years ago and never paid some of his workers. he would get men from the Grand Hotel to do work and never paid them. they were afraid to complain.

After reading all the comments here, I can’t believe how surprised most of you are that this kind of behavior happens in government. It doesn’t matter at what level you’re talking about, all government, given power, will have bad apples. They all say what we want to hear, they make themselves look like they’re doing what we want them to do, and all the while, they won’t upset their apple cart. It happened for years in the White House, and it’ll happen here, and even at the corner drug store.

When an elected official pleads guilty to crimes that are serious enough to be punishable by up to 33 years in prison, the next step should be immediate resignation or termination. Her credibility is ruined, and she cannot be trusted with any further responsibility effective immediately.

Does anyone remember back several years ago when Rogers did over $60,000 worth of work on her house and her property taxes didn’t go up when everyone elses did.Maybe justice is finally starting to catch up with some of these untouchables. I bet there is some people in Middletown starting to swear.

With any plea deal comes the revelation of new information. With former Dynus employees George Lang and Scott Owens, you’ve got to wonder the extent of their Dynus involvement especially with Rogers acting as treasurer of Lang’s campaign and Owen’s using his foot to gain access to the inner sanctums of Hamilton’s Main Street government buildings. Not to mention the foot dragging by Pipers office. If any of them are implicated I would expect Furmon and the GOP to also ask for their heads.
