Ohio Supreme Court rejects Dayton Tea Party case
Without comment, the Ohio Supreme Court, in a 6-1 vote, on Wednesday dismissed a lawsuit filed by the Dayton Tea Party aimed at requiring the Ohio Municipal League and the Ohio Township Association to release records about their finances, operations and lobbying efforts.
The dissent came from Justice Robert Cupp, who said he would have granted an alternative writ, meaning he was open to being further briefed on the case.
The lawsuit, filed in June, grew out of a public records request from the Tea Party filed in an effort to find out more about the two groups’ opposition to repealing Ohio’s estate tax and support for increased spending for local governments.
The two groups argued that they were not subject to Ohio’s public records requirements.
“It was worth a shot,” said Rob Scott, Dayton Tea Party president. Filing the lawsuit at least “shed light” on the tax dollars that cities and townships were sending to the two “quasi-governmental” entities to lobby for more tax dollars.

Dick Armey and Freedom Works don’t work for free, so perhaps transparency isn’t particularly what this faux front group wants afterall. They just like the free publicity this stunt bring to them.

The tea party simply asked for some records, which doesn’t implicate race at all. Frankly I’m glad they’re shaking down the OTA, as I worked there for a summer as a student and couldn’t believe the waste. You people commenting should really get the facts.

The Tea Party people are everyday tax paying people who want to retain our rights and freedoms with minimal govt. control. The negative characterizations don’t hurt us a bit, there Mr. Comment. The Tea Party loss in court we tried, we lost. No big deal. The message is still the same. No big government, no new taxes. I have recently noted how wholesome the President and First Lady seem to present themselves. The contact with corrupt union reps does not show with their smiles. Their plans with Cass Sunstein and Van Jones to take away our gun rights and create environmental regulations we can’t afford are also hidden behind their wholesome smiles. Should unions represent public employees when they can cause we the people’s taxes to go up? I say, “NO!” All of that is hidden behind the Obama’s wholesome smiles that I don’t buy.

This teabrain party is nothing but an advertising wing of the same republican cult. Selfish fools who have no idea how this society came to be and what its existence depends on. Taxes in this country are lowest they’ve been since the early 1900’s. Yet they stump the same tired mesg. The benefit of taxes is civilization. These Carpetbaggers have brought the country to its knee’s taking redicules tax breaks to invest in slave labor abroad. That in turn has destroyed the American middle class and the tax base that it provided. Ninety eight percent of these thieves were public educated yet they lobby against every levy providing American kids with the same. This insanity will end soon. No jobs, No education, no food. When the cost of our infrastructure increases faster than tax base, do those who put down those that work to find a solution find it their heart to send extra money on tax day or do they just complaint more. It is legal to pay more than you owe in tax in fact you don’t need to wait just write the check and send it.

So the question is, should tax payer money be used to lobby for more money from tax payers? Imagine someone who owes you $100 gives back $10, then asks for a loan of $100 because, “look I’m good for it, I’ve payed you $10.” The TEA party should take pride in being insulted and defamed… it indicates the effectiveness of their message. I like the squeal of the government vermin… it sounds like the prelude of a victory anthem for true patriots.

I told a Tea Partier the other day who was complaining about a cut in services in our local courthouse that cuts in taxes mean cuts in service. Still don’t think he made the connection. I’m very glad they lost this case

Thank you Tea Party, for advocating for the taxpayer. The estate tax is so wrong.. its caused peple to sell their farms or their houses or take out loans— just to pay the Tax. Its double-taxing, and unfortunately it hurts the person receiving the inheritance in many cases.

Rep. Joe Walsh is a deadbeat dad who claimed he was too broke to pay child support for years, while managing to loan his own campaign for Congress over $35,000. At the same time, he was paying more for rent than he reported in income. He is one of your tea pots. Nice work.

The dems voted for nearly $1b that was supposed to be used for infrastructure needs. Where did that go. In terms of schools, many districts (huber, trotwood, etc) have new schools and immediately either closed buildings or went after huge levies or both. The tired old arguments that all we have to do is increase spending to solve all our problems is ridiculous

There’s some irony in the Tea Party bringing a challenge to the Supreme Court which they knew was weak (“it was worth a shot”), since the cost of dubious legal challenges might be categorized as waste of tax payer money.

Josh, if you think all the tea party talks about cutting taxes, then all you have been doing is listening to the mainstream media who think they know all about the tea party. The more tax revenue we have given has not improved our infrastructure or our schools, money is not the answer to everything. We pay specific taxes for funding our roads, so why are our roads not maintained - a pol and a democrat will tell you it is because they don’t get enough from the taxes designed to pay for it, what a load of junk. We pay taxes that are specifically set for maintaining the roads, but if the government is going to pay $16 for a muffin don’t you think they have overpaid for repairs, maybe that is why they do not have enough to maintain. Should we pay more gas tax for road repairs, because the government is wasteful of our money and assumes we will just pay more? Tea party groups are paying attention to their local communities and stopping the status quo of stupid spending. How’s that Austin project working for you?

If the Association and the Municipal league receive and use public funds either directly or indirectly from member communities, then they may be considered a non-governmental entity, but still are subject to disclosure (sunshine) laws. Tea Party — get your legal team to draft the right kind of challenge. then get lower court to reject it and get it back before the OSC before they recess, that way i may be heard before primaries are held in May 2012

Some local municipalities (like Oakwood) didn’t like the fact that the Ohio estate tax was going away. So they hired their own lobbying folks to get it changed. Fortunately they failed. People who earn something shouldn’t have to give the state a share of it when they drop dead. They should be allowed to pass it on to their heirs, charities, etc as they see fit. The Tea Party was doing Ohio taxpayers a favor by looking into this.

Sometimes the Tea Party makes a good point, there are obvious inefficiencies in all levels of government that lead to waste. However, all they ever talk about is cutting taxes. How exactly do they expect to keep the nation’s infrastructure from crumbling with less tax revenues? What about the schools? Our public schools are getting worse and worse yet we want to keep cutting their budgets? Yeah, GREAT plan to put this nation back on track.
