Case could be months away
Oral arguments in the land transfer case involving Middletown and Franklin schools could be months away, Franklin Superintendent Arnol Elam said the district’s lawyers told him.
Final arguments were filed last month in Middletown’s appeal of the decision to deny the transfer of 1,600 acres of land mostly east of Interstate 75 from Franklin City Schools.
Middletown’s appeal calls into question whether the Franklin County Common Pleas Court abused its discretion when it upheld a decision by the Ohio State Board of Education to deny the transfer.
A panel of three judges will hear oral arguments in the case, according to the 10th District Court of Appeals in Columbus, but a date has not yet been set.
