Middletown cites evidence in appeal

Middletown’s land transfer appeal documents say the Franklin County Court of Common Pleas “erred in affirming the decision of the state board - the decisions were not supported by reliable, probative and substantial evidence.”

The county court answered all Middletown’s claims in its ruling.

One thing I found interested was question #14 on the appeal documents, which were submitted by Middletown’s attorney.

Have settlement discussions taken place since the judgment (which is spelled judgement in the document) or order appealed from was entered?

Franklin Board of Education President Chris Sizemore said Franklin was contacted by Middletown asking for a revisit of previous settlement discussion regarding open enrollment.

Sizemore said this far along in the process, he wasn’t interested in revisiting previous discussions, but he did ask for something in writing. He said he did not receive anything in writing, except the appeal documents.
