Another charge for senate candidate

Michael Shawn McCabe, a candidate seeking the appointment for Ohio’s 4th Senate District, will be in Area II Court on June 1 on suspicion of telephone harassment. He was just in court this morning, May 18, for criminal trespassing.

His legal troubles are surrounding his pending divorce, which he said is set to be final on June 13.

According to the Fairfield Twp. police, McCabe’s estranged wife filed on May 11 a telecommunications harassment report against him. The report states “she has told Michael numerous times to stop texting her. Michael was sending texts that often involved hostile statements.”

McCabe said the messages were an attempt to coordinate an exchange with their children, though the report states they were “unwanted text messages.”

The first-degree misdemeanor charge will be heard in Area II Court.

McCabe — who’s soon-to-be ex-father-in-law is Fairfield Twp. Trustee Mark Sutton — was in court earlier Wednesday, May 18, for criminal trespassing, a fourth-degree misdemeanor, for a March 15 event at Fairfield North Elementary on Morris Road. A not guilty plea was entered and a jury trial has been set for 2:30 p.m. on June 22 in Area II Court.

The criminal trespassing police report states McCabe “had caused problems at the school on several earlier occasions and had received a written notice not to come back on the premises.”

McCabe said that is false. He said he was escorting his then-girlfriend’s child to the office. An employee of the school saw McCabe walking in the hallways and notified the principal.

McCabe said on Tuesday: “I’ve never had any incident at that school.”

The state senate-hopeful is looking to garner a recommendation this evening from the Butler County Republican Party to be the next District 4 State Senator. The Ohio Senate Republican Caucus will make the actual appointment. Sen. Gary Cates, R-West Chester Twp., is resigning his position to take a job as senior vice chancellor with the Ohio Board of Regents. He starts on May 23.

• Rep. Cliff Hite, R-Findlay, was appointed on Jan. 3 to fill the seate of former Ohio Sen. Steve Buehrer who was appointed as administrator/CEO of the Ohio Bureau of Worker’s Compensation by Gov. John Kasich.• Attorney and law professor Larry Obhof Jr. was appointed on Feb. 1 to fill the seat of former Ohio Sen. John Husted, who was elected in November as Ohio Secretary of State.

• Rep. Peggy Lehner, R-Kettering, was appointed on Jan. 11 to fill the seat of former Ohio Sen. John Gibbs, who was elected in November to the U.S. House of Representatives.
