Morning spent on background during the Lang trial

CINCINNATI — In the morning of day two in the federal perjury trial of West Chester Twp. Trustee George Lang, a lot of the time was spent introducing background and past testimony.

The prosecution spent the first 90 minutes of the trial on Tuesday, Feb. 1, time with the first witness of the day, FBI Special Agent Kevin Gormley. The prosecution and Gormley spent much of the time reading excerpts from testimony from the Orlando Carter trial. Carter was the former owner and president of Dynus Technologies who was found guilty of a number of federal charges and sentenced to 15 years in prison.

Transcripts read were from former Butler County Republican Party Executive Director Scott Owens and James Smith, the former Dynus employee who Lang said he didn’t know he worked for Dynus at the time he was working with Lang.

They also read transcripts from Lang’s testimony, which indicated at the time payments Lang made to Smith were made before he started at Dynus.

The point of the previous testimony was to introduce the transcripts into the record for the jury as Gormley was at Carter trial and worked on the Dynus investigation from the beginning.

After the background was introduced, the prosecution and Gormley reviewed documents from Lang’s appointments, a Dynus salary list and two employment agreements in 2004.

During the background testimony, it was restated Lang did not know Smith was an employee of Dynus until January 2005.

One question restated was:

From the prosecution: “And, to your knowledge, at the time that that commission was earned, was he working for anyone else?”

Lang’s answer: “No, although I think he — he may have just started working for Dynus as an employee right about the time we got the check. But the check was for work that had been done previous to that point in time.”
