Gmoser gets FOP endorsement for prosecutor

As I mentioned in this story, the race for the next Butler County prosecutor is already well under way, even though the seat isn’t yet open.

Below is a letter local attorney Michael Gmoser sent to members of the Butler County Republican Party central committee, which will likely appoint the next prosecutor next year. The current prosecutor, Robin Piper, is running unopposed for a judgeship, so his unexpired term will be filled by the local GOP if he wins. Gmoser’s GOP opponent is Jason Phillabaum, an assistant county prosecutor.

Here is the letter, in which he boasts of an endorsement he received from the union representing Butler County sheriff’s deputies:

As a member of the FOP, I never received notice of this endorsement. I would never had voted for Gmoser who sued a police officer. Our President (Gebhart) pushed his agenda through and is in Gmoser’s pocket. Phillabaum is the only candidate that is or was a full-time prosecutor.

FOP Member, you are dead wrong about Phillabaum! He allegedly knowingly withheld evidence in a felony case that would have cleared the defendant. Phillabaum should not be prosecutOR, he should be prosecutED. Luckily, the accused had a good attorney, Mike Gmoser, who found the evidence and got his client acquitted. And Mike started his career in the prosecutor’s office, under Holcomb. Just because Gmoser was the attorney in a case involving a cop does not disqualify him. The last time I checked, cops were human and can make mistakes. Get past the badge and know more about what is at stake here.

Mike Gmoser is one of the most respected and talented attorney’s in Butler County. The FOP endorsed him for very good reason. Also, how is it any better to accuse another officer of unethical conduct (i.e. being in someone’s pocket) than it is to sue them? “FOP member” is a hypocrite.

Phillabaum has more relevant experience than Gmoser. Phillabaum has been a prosecutor for over 10 years (now). Gmoser was a part-time prosecutor in the 70’s. Phillabaum has prosecuted more cases in the past 4 years than Gmoser has in the past 40 years.

To Litigator, Of course you want your defense-attorney buddy to be prosecutor. You probably think you will get better deals with your buddy in power. I find it funny that you would rather go against Gmoser as prosecutor that Phillabaum as prosecutor. The best thing for Phillabaum is for defense attorneys to endorse Gmoser.

Why does Gmoser want to do this? He is only 3 years away from vesting in OPERS. We should not elect him just to get public retirement.

Gmoser said he wants to be a part-time prosecutor. Why? As a part-time prosecutor, he can have a civil practice and continue to make loads of money. As a part-time prosecutor, he can also have his civil firm represent the victims in criminal cases.

I don’t mind people arguing over my qualifications, but the OPERS information is incorrect. I withdrew my retirement in 1974 to get married and then did it again in 1982 to start my practice. I have no retirement to vest. Thank you for your concern.

Convicted Felons and former clients are campaigning on behalf of Gmoser. As a mother of 3, I don’t want a prosecutor that felons and former criminal clients want in the office. Gmoser will be BAD for Bulter County.

If Gmoser is so bad, why did the FOP endorse him? Kind of a slap to someone like Phillabaum who works with them every day. Phillabaum has had cases sent back from the Court of Appeals due to prosecutorial misconduct. Is that good

Really? Is this really Mike posting under a false name? Mike, why don’t you tell them about allegations of prosecutorial misconduct against you? Didn’t you have a murder case reversed due to prosecutorial misconduct? How many cases were dismissed when you were prosecutor due to misconduct OR failure to comply with requirements? We were not able to ask you about that in the FOP meeting. Had Gebhart let us an actuall meeting with proper notice, you would NEVER have been supported! Also, didn’t your case suing police get dismissed because your client KILLED somebody and then SHOT himself. Mike, you have must have been a great judge of character - representing a murder over and against a police officer. Shame on you!!! SHAME ON YOU!!!

The lone allegation of prosecutorial misconduct that I had involved a case in which I was defending police officers during my closing argument regarding defense tactics. The conviction was affirmed by all Courts of Appeal including the Ohio Supreme Court and also the U.S. Court of Appeals from which no further appeals were taken. The killer stayed in jail throughout. All of these arguments were made against me at the FOP meeting and still didn’t get the endorsement. I’m also perfectly capable of posting in my own name.

I am fed-up with negative politics. Mike, you sound angry and defensive, and I am done with your negative attacks. I don’t hear one positive thing from you - you only try to tear down Phillabaum. FOP Member, you sound like somebody that didn’t get his way and is also bitter, getting mean spirited towards Mike. We need a politicians that can stay above this petty chatter and get the job done. Mike, you lost my vote my getting in this mud-slinging contest with FOP! You should be above it (and you should be working right now.)

Gebhart is a “snake,” and he is the true hypocrite. Gebhart just fought with the Sheriff about salaries and “taking cuts,” but (according to this paper), Gebhart makes over $81,000 per year and is in the highest 10% of all county employees. Looks like Gebhart is only interested in what will make him richer. (I guess he and Gmoser have more than one thing in common.)

I agree with Fed-up. This is funny. The “mature” candidate is writing in these blogs like my 14 year old. He has to get the last word. Real “mature” Mike. If you become prosecutor, are you going to work part-time and then spend the rest of your time responding to all of the blogs on the journal that don’t like what you are doing?

Mike, After the FOP meeting, I looked up the James Ruppert case you mentioned. You claimed to get 11 convictions on that case, but records show all 11 counts were reversed by the Appellate Court. Why would you mislead us? The convictions you claimed were thrown out of court. I wish we could re-vote on that letter now.

Jeff, If he was trying cases when Jason was in daipers, how old is Mike now? If we elect Mike in 2012, he’ll be close to 70 years old. We could elect a prosecutor wearing daipers while trying cases.

Mike, why don’t you tell them the real truth about you suing a police officer. That police officer was right - he arrested a killer. You got him off. After you got him off for rape, he KILLS another woman. Meanwhile, you sued the police officer that got the right man. Mike, do you feel responsible for that woman’s death? Do you sleep at night? Police officers may make a mistake - but that officer was a great man. Mike, you are not a great man. He tried to protect the public. You got a man off, and that man KILLED an innocent woman.

The FOP did not know all of this when they questioned Mike. Had the FOP known all of the truth, they would never support this defense attorney. Had the members known the full story about Gebhart, the woman’s death, the misleading case information, we would have escorted you out of our building. Mike, are you willing to come back and tell the whole story this time?

Hey Mike, is it true that you were yelling at the women’s club? The story I heard was that you were like a bull in a china shop. Did you really come “unhinged” when answering tough questions? That doesn’t seem like a good quality for prosecutor. I would vote for anybody over you.

A quick call to PERS will reveal that you can buy back all of your time 18 months after resuming employment. I want my original post reinstated that speaks to the PERS, retirment, medical as well as Gmoser being extremely incompetent for losing cases for failure to prosecute on time and for having the conviction he champions overturned at the Court of Appeals.
